Terms of use
The conditions of access to and use of the Fideluz platform.

Purpose
These terms of use (the “Terms of Use”) set out the conditions of access to and use of the Fideluz platform (the “Service”), published by FIDELUZ SAS. They apply to anyone accessing the Service, whether a professional user of the Platform or a loyalty-card holder (the “User”).
Acceptance
Accessing and using the Service implies full and unreserved acceptance of these Terms of Use. A User who does not accept them must refrain from using the Service. For use of the Platform, these Terms of Use supplement the terms of sale applicable to subscriptions.
Description of the Service
Fideluz lets merchants create, distribute and run digital loyalty cards added to Apple Wallet and Google Wallet, and lets holders add and view those cards. No dedicated app is required: the card installs in the phone's native wallet.
Access and account
Access to the professional area requires creating an account and providing accurate information. The User is responsible for keeping its credentials confidential and for any activity carried out from its account. Card holders access their pass without an account, through their wallet.
Proper use
The User undertakes to use the Service in accordance with its purpose, these Terms of Use, public order and applicable law. In particular, the User must not: disrupt the Service; attempt unauthorised access; distribute unlawful, misleading or infringing content; or misuse the Service for fraudulent purposes.
Role of Apple and Google wallets
Cards are hosted in Apple Wallet and Google Wallet, third-party services subject to their own terms. Fideluz is not responsible for the availability, changes or operation of these third-party services, nor for operating-system updates that may affect their use.
Points, visits and rewards
The award of points, visits and rewards is the responsibility of the merchant who defines its programme. Only the merchant can credit points or visits, through a secure interface; holders cannot change their own balance. Fideluz provides the technical tool and is not a party to the commercial relationship between the merchant and its customers.
Availability
Fideluz endeavours to keep the Service continuously available, subject to maintenance, updates and interruptions beyond its control. Access may be temporarily suspended for technical or security reasons.
Intellectual property
The Service, its structure, components and the Fideluz brand are protected by intellectual-property law and remain the property of Fideluz. Any unauthorised reproduction or use is prohibited. Content belonging to the merchant (logo, visuals) remains its property.
Personal data
The processing of personal data is described in the privacy policy. The User has rights of access, rectification, erasure and objection, which may be exercised with dpo@fideluz.com.
Liability
Fideluz provides the Service under an obligation of means. Its liability is limited to direct, proven damage and cannot be engaged for interruptions attributable to third-party platforms, networks, misuse of the Service or force majeure.
Suspension and termination
Fideluz may suspend or close access in the event of a breach of these Terms of Use, in particular fraudulent use or use that harms the security of the Service, after informing the User where possible.
Amendments
Fideluz may amend these Terms of Use to reflect changes to the Service or to the law. The applicable version is the one in force when the Service is used; substantial changes are notified to Users.
Governing law
These Terms of Use are governed by French law. Any dispute regarding their interpretation or performance falls, failing an amicable resolution, within the jurisdiction of the French courts of the registered office of FIDELUZ SAS.
